ТHE PRESIDENT MUST NOT BE HEAD OF THE COUNCIL OF JUSTICE
Support A1+!On the initiative of the American Bar Association the Armenian judges and lawyers have been discussing the Constitution Amendments. They have come to an agreement that suggestions must be done in the article about the basic freedom and rights of man and citizen, about the formation of the Council of Justice and its working process.
The participants of the seminar which took place in Tsaxkadzor 28-30 of January have discussed mainly the draft constitutions put forward by the Coalition and «The United Working Party».
According to the participants, there are serious restrictions of human rights in the draft constitutions. Both the judges and the lawyers are convinced that the Head of the Council of Justice must not be the President of the Country, as is preseen by the working Constitution. According to Judge Ara Koubanyan, the Head of the Council must be the Head of the Court of Appeal, and the Council must include mainly Judges. Lawyer Hayk Aloumyan does not support the view of the majority of judges, asking how they will judge themselves.
Judge Koubanyan answered the question of whether the change in the order of formation of the Council of Justice is a full condition for the independence of judged, that the independence of judged by all means depends on other factors too – economical, financial, etc.
