Bailiff committed embezzlement using his official position
Citizen Armenuhi A. gave a communication on the fact that with the purpose of making a payment to the account number of enforcement proceedingsinstituted for confiscation of the debt of her daughter to “Armentel” CJSC within the period from December 20, 2007 to the summer of 2010, she part by part conveyed and handed 600 thousand RA drams to RA Ministry of Justice JAE Service Regional Division bailiff, who, not paying on the account number of the proceedings, embezzled an sum of considerable amount – about 152 thousand RA drams. On the basis of citizen Armenuhi A.’s communication, by the materials prepared in RA Special Investigation Service criminal case has been instituted on incident of committing embezzlement of another person’s property by the bailiff in considerable amounts by means of misappropriation using the official position thereof pursuant to the features of point 1, part 2, Article 179 of RA Criminal Code. Preliminary investigation is carried out. Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
