The Human Rights Defender applies to the Constitutional Court for the protection of the property rights of the organizations
The Armenian Ombudsman has received appeals on the constitutionality of certain articles of the RA Law on Profit Tax and some of the Government Decree-making provisions. The law, defining the decision and payment of profit tax, does not explicitly define some terms used therein. As a result, these terms are defined by a lower legal force - the Government Decree. Moreover, the law does not provide with the disclosure of the terms used therein by the Government decision. It turned out that in the current situation a problem of the organization's right ownership realization arises, in terms of the guarantees fixed by the Constitution. A comprehensive review of legislation has been submitted to the Constitutional Court for the solution of this systemic problem, Human Rights Defender's Office reports.
